TRUSTEE’S SALE OF REAL PROPERTY
By authority of an order recorded in case # C-12-CV-19-001025 of the Circuit Court of Harford County, Maryland, appointing Carolyn W. Evans, Trustee, will offer at Public Auction 3,496 SF Store Front style building with alley access, in the Downtown Havre de Grace Commercial District on:
Tuesday, August 6, 2024 @ 11:00 AM, ON PREMISES.
All that lot or parcel of ground situate and lying in the City of Havre de Grace, in the Sixth Election District of Harford County, State of Maryland, fronting forty-four (44) feet on the westerly side of St. John Street, and extending back therefrom an irregular width to Lodge Alley and bounding thereon twenty-five (25) feet. BEING the same and all the land described in a deed dated October 8, 2018, and recorded among the Land Records at Harford County in Liber No. 13025, folio 322. The improvements thereon being known as:
312 St. John Street, Havre de Grace, MD 21078
The property will be sold in an “AS IS” condition without either expressed or implied warranty or representation, including but not limited to the description, fitness for a particular purpose or use, structural integrity, physical condition, availability of utilities, flood hazard, lead paint violations, construction, extent of construction, workmanship, materials, liability, zoning, subdivision, environmental condition, merchantability, compliance, with building, or housing codes, or other laws, ordinances or regulations or other similar matters, and subject to easements, agreements and restrictions of record, and to any rights, of tenants or other parties or persons in possession which affect the same, if any.
TERMS OF SALE: A $10,000.00 deposit payable by cash, certified check, or cashier’s check, will be required of the purchaser at the time and place of sale. The balance shall be paid in cash/certified check within 10 days of final ratification of the sale, time being of the essence. In the event of default by the purchaser, including failure to timely remit the balances due, and at the risk and expense of said purchaser, the Trustee may declare the deposit forfeited and resell the premises. In such an event, the defaulting purchaser will be liable for payment of all costs and expense of both sales and any deficiency in the sale price realized in the subsequent sale. The forfeited deposit, less expense, shall be credited towards the judgment after final ratification by the Court. The sale shall not be final until ratification by the Court. The Trustee makes no representations, warranties, either expressed or implied, with respect to the condition of the Properties, any improvements, or as to the sustainability of the Properties for any particular purpose. In the event of a defect of title, the Purchaser’s sole remedy shall be the refund of the deposit. The Purchaser shall be responsible for all settlement costs, including but not limited to; title examination, if any, recording costs, documentary stamps, transfer taxes, and document preparation. No Buyer’s Premium. The Purchaser is responsible for obtaining physical possession of the property.
Inspection: No showings or building access. One hour prior to Auction, registered bidders may peer in the doors only. No access will be granted.
All real estate taxes, charges and assessments will be adjusted as of the date of sale and closing shall take place on or before 10 days after final ratification of the sale by the Circuit Court for Harford County, time being of the essence.
