By authority of an assignment of mortgage made the 3rd day of July, 2013 and duly recorded among the land records of Harford County, Md. in Liber 10371, Folio 505 the below listed assignee will offer for sale at public auction on:

Tuesday, August 26, 2014 @ 11:00 am

All that lot or parcel of ground situate and lying in the CITY OF ABERDEEN, in the SECOND ELECTION DISTRICT of Harford County, Maryland being known and designated as Lot No. 60, as shown on a plat entitled, “North Deen, Phase 1”, which Plat is recorded among the Land Records of Harford County in Plat Book No. 4, Folio 74. The improvements thereon being known as No. 142 Allendale Avenue.

Being the same and all the land granted and conveyed by and described in a deed dated May 1, 2008 and recorded in the land records of Harford County in Liber 7828, Folio 501 from B. Michael & Sons, Incorporated, formerly known as Baldwin Manor, Incorporated unto Donald L. Peaker, Jr.

The improvements consist of a one level standard unit built on a slab. The property will be sold in an “AS IS” condition and subject to conditions, restrictions and agreements of record affecting the same, if any; and with no warranty of any kind.

Terms of Sale:
A deposit of $5,000.00 will be required at the time of sale, such deposit to be in cash, cashier’s check, certified check or in other form acceptable to the Assignee. Balance of the purchase price is to be paid in cash within ten (10) business days of the final ratification of sale by the circuit Court for Harford County. If payment of the balance does not take place within ten business days of ratification, the deposit will be forfeited and property will be resold at the risk and expense of the defaulting purchaser. The defaulting purchaser shall not be entitled to any surplus proceeds or profits resulting from any resale of the property. Interest to be paid on unpaid purchase money at a rate of 5% (five percent) from date of sale to date funds are received in the office of the Assignee.   In the event settlement is delayed for any reason, there shall be no abatement of interest. Taxes, ground rent, water, rent, condominium fees and/or homeowner association dues, all public charges, assessments payable on an annual basis, including sanitary and/or metropolitan district charges, if applicable, to be adjusted for the current year to date of sale and assumed thereafter by the purchaser. Cost of all documentary stamps, transfer taxes and settlement expenses shall be borne by the purchaser. Purchaser shall be responsible for obtaining physical possession of the property. Purchaser assumes the risk of loss or damage to the property from the date of sale forward. If the Assignee is unable to convey good and marketable title, the purchaser’s sole remedy in law or equity shall be limited to the refund of the deposit. Upon refund of the deposit, this sale shall be void and of no effect, and the purchaser shall have no further claims against the Assignee.
