By virtue of a Decree in the Civil Case of Clifford Cantrell, Jr. vs. Amanda M. Castelan aka: Cantrell in the Circuit Court of Baltimore County, Md. # Case No. 03-C-09-009460, Brian Bennett having been duly appointed Trustee, the undersigned Trustee will offer at public auction on the Circuit Courthouse steps located at 401 Bosley Avenue, Towson, Md. 21204. FRIDAY, MAY 7, 2010 @ 2PM Being known and designated as Lot 43 in Block C as shown on the Plat on Friendship Gardens, Section 2, which Plat is recorded among the Land Records of Baltimore County in Plat book GLB 22, Folio 021. The improvements thereon being known as 4459 Scotia Rd. In Fee Simple. Being the fee simple property which, by Ground Rent Merger Deed dated October 10, 1973, and recorded in the Land Records of the County of Baltimore, Maryland, in Liber 5408, Folio 288, was granted and conveyed by Security Management Corp. unto Clifford O. Cantrell and Mollie L. Cantrell. Being also the leasehold property which, by Deed dated November 4, 1959, and recorded in the Land Records of Baltimore, Maryland in Liber 3623, Folio 511, was granted and conveyed by Superior Houses, Inc. unto Clifford O. Cantrell and Molly L. Cantrell, erroneously referred to as Mollie L. Cantrell. Clifford O. Cantrell having since departed this life on or about October 31, 1984 thereby vesting sole ownership by right of survivorship unto Molly L. Cantrell. Terms:$5,000.00 paid by CERTIFIED or CASHIER’S check at time of sale with the balance paid within 15 days of final ratification of the sale by the Circuit Court for Baltimore County or the deposit shall be forfeited and the property resold at the risk and cost of the defaulting purchaser. Interest on the unpaid balance to accrue at the rate of seven percent (7%) from date of sale to date of settlement. Taxes and other assessments payable on an annual basis to be adjusted from the date of sale. All costs of transfer including documentary stamps, transfer taxes and any agricultural transfer tax to be paid by the Buyer. The property is sold “AS IS” and is subject to all easements and restrictions which may apply. If the Trustee is unable to convey good and marketable title, the purchaser’s sole remedy in law or equity shall be limited to refund of the deposit to the purchaser. Upon refund of the deposit this sale shall be void and of no effect, and the purchaser shall be void and of no effect, and the purchaser shall have no further claim against the Trustee.
